Terms and Conditions

1. Who we are
These terms and conditions apply to all products supplied by Covertec Structures Ltd, a company registered in England and Wales under number 04926308, whose registered office is The Lodge, Leicester Road, Lutterworth, England, LE17 4LU. In these terms, "we", "us" and "our" mean Covertec Structures Ltd, and "you" means the individual, business or corporate body buying from us. If you place an order on behalf of a business, you confirm you have authority to do so and the business will be our customer.
2. These terms
These terms govern every sale of our products, whether you order through our website at covertecstructures.co.uk, by phone, by email or by accepting a quote. Please read them before you order. Nothing in these terms affects your statutory rights as a consumer.
3. Your order and the contract
Your order, whether placed through the website or by accepting a quote, is an offer to buy. We will send you an order acknowledgement in writing once we have processed your order, and a legally binding contract is formed when we send it. You may ask to change your order at any time before we start making it. Because our products are made to order, changes after production starts may not be possible or may carry a charge.
4. The products
Every product is made to order at our own production site. Made to measure products are manufactured to the measurements you give us, and standard size products to the published size you choose. We make every reasonable effort to ensure our products match the photographs and descriptions on our website, but we cannot guarantee they are precisely accurate, and colours on a screen may differ from the finished product. We may make minor changes to a specification, including any change needed to meet a legal or safety requirement.
5. Measurements, fitting and use
Where a product is made to your measurements, you are responsible for making sure those measurements are correct. We publish measuring guides and are happy to check details with you before you order, but we cannot be held responsible for a product made accurately to incorrect measurements you have supplied.
Our products are supplied as self fit kits with a printed guide and a step by step video. We do not offer a fitting service and we do not carry out site surveys. You are responsible for making sure the building or space is suitable for your chosen product, for fitting it in line with our instructions and for using it as intended. We cannot be held responsible for incorrect fitting or improper use.
6. Price and payment
The price payable is the price shown at checkout, or on our accepted quote, at the time you place your order. All prices are in pounds sterling. Delivery charges, where they apply, are shown before you pay. Our prices may change at any time, but a change will not affect an order we have already accepted. If we find a genuine pricing error in an order we have accepted, we will contact you before going further and you may cancel for a full refund.
Website payments are taken in full at the point of order and are processed by our secure payment provider, Stripe. Your card details go directly to Stripe and are never seen or stored by us. For orders placed against a quote, payment terms are stated on the quote. If a payment due to us is not made on time we may suspend production or delivery, and for business customers we may charge interest in line with the Late Payment of Commercial Debts (Interest) Act 1998.
7. Delivery
We deliver to mainland UK addresses. Every product is made to order, and the lead time we give you when you order, or in your order acknowledgement, is our genuine estimate. Delivery dates are approximate and we will not be liable for delay outside our reasonable control, though we will always keep you informed. If nobody is available to receive the delivery and it cannot be left in a safe place you have nominated, the courier will leave instructions for rearranging delivery or collection.
Risk in the products passes to you on delivery. Ownership passes to you once we have received payment in full in cleared funds.
8. Cancellation by you
If you are a consumer, your cancellation rights depend on what you have ordered:
- Made to measure products, including anything designed in our configurator to your measurements, are made to your specification. The usual 14 day cooling off period under the Consumer Contracts Regulations 2013 does not apply to them. Once we have accepted your order, it can only be cancelled with our written agreement, and we may deduct costs we have already incurred.
- Standard size products bought from our online shop can be cancelled up to 14 days after delivery. Tell us in writing within that period, then return the products unused, in their original condition and packaging, within 14 days of telling us. You pay the cost of return, and we will refund you within 14 days of receiving the products back.
These rights are separate from your rights when a product is faulty, which are covered in clause 9 and are not limited in any way.
9. Faulty products
Please inspect your products on delivery and tell us as soon as possible, and in any event within a reasonable time, if anything is damaged or defective, ideally with a few photos and your order details. If a product is faulty we will repair it, remake it or refund you, as the Consumer Rights Act 2015 provides. Where we ask you to return a faulty product, we will not leave you out of pocket for the return.
10. Guarantee
Our products are guaranteed against faults in our manufacture and materials for up to 10 years, depending on the product. The period for each product is stated on its product page, and what is covered, what is not and how to claim are set out on our guarantee page. The guarantee is in addition to your statutory rights, not in place of them.
11. Cancellation by us
We may cancel your order before dispatch if we are unable to make or source what you have ordered, or if an event outside our control prevents us fulfilling it. If we cancel, we will confirm in writing and refund anything you have paid within 14 days.
12. Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Subject to that, we will not be liable for loss of profit or any indirect or consequential loss, and our total liability under a contract will not exceed the amount you have paid under it. If you buy as a consumer, nothing in this clause affects your statutory rights.
13. Events outside our control
We will not be in breach of these terms, or liable for delay or failure to perform, if the cause is an event outside our reasonable control, such as a failure of supply, extreme weather, industrial action or a power or transport failure. We will let you know, and if the event goes on for more than 30 days either of us may cancel the order with a refund of anything paid for products not delivered.
14. Your personal information
We collect, hold and use your personal information in line with UK data protection law. Full details are in our privacy policy.
15. General
You may not transfer your rights or obligations under a contract with us without our written consent. We may subcontract parts of an order, such as delivery, but we remain responsible to you. If any part of these terms is found to be invalid or unenforceable, the rest remains in force. No delay by either party in exercising a right is a waiver of it. A contract under these terms is between you and us, and no third party has rights under it.
16. Law and jurisdiction
These terms, and every contract made under them, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute. If you are a consumer, you keep the benefit of any mandatory protections of the law of the part of the UK you live in.
